The third article of the law "On Veterans" lists the following persons who are eligible for a privileged title:

  1. Servicemen, as well as retirees who participated in hostilities while on duty. Including:

    • employees of the penal system;
    • state security officers;
    • military.
  2. Soldiers who took part in the demining of land and water areas of the USSR in the period from 05/10/1945 to 12/31/1957.
  3. Participants in the operation in Afghanistan, including employees of auto battalions, flight units;
  4. Civilian pilots and auxiliary personnel who flew to Afghanistan during the war and received:
    • injury or mutilation;
    • state awards.
  5. Employees who have worked in Afghanistan for the due time in the direction of government agencies or who graduated from work for a good reason.
  6. Participants in the Syrian operation from 09/30/15.
  7. Participants (by decisions of the executive power Republic of Dagestan) military operations as part of self-defense detachments of the Republic of Dagestan in the period from August to September 1999 during counterterrorist operations in the territory of the Republic of Dagestan - from 1.01.

The list covers the period from the Civil War to the present day. In particular, its text specifies operations in the following countries:

Algorithm for obtaining the title

Retirees and civilians who took part in military operations are required to apply to a government agency with an application for a veteran's certificate. According to the Procedure, civil servants carry out the following work:

  1. The application is registered in a special journal.
  2. The submitted documentation is carefully checked.
  3. The head makes the appropriate decision.
  4. The applicant is informed about its essence in writing:
    • invite to come for the Department of Internal Affairs;
    • explain the reason for the refusal.

Where to go

IN regulations there is a list of federal authorities that have been delegated the authority to draw up the relevant documentation. Since we are talking about the military, they should contact them:

What documents will be required


The applicant is obliged to documentally prove compliance with legal requirements. The package must include the following papers:

  • copy of your passport;
  • an order to send to work in a hazardous area, included in the annex to the law;

Procedure for obtaining UVBD


The certificate is an official document giving the right to receive preferences at public expense. Its form was approved by the above government decree. In addition, the text contains the following rules:

  • the document is filled out by the authority that issued administrative document about his extradition;
  • the following information is entered into the form:
    • Full name of the veteran without abbreviations;
    • full name of the state body that issued the issue;
    • benefits code from "1" to "3";
    • surname, initials and position of the head of the government agency;
  • a completed signature form is issued.

  • manager's signature;
  • photo of the veteran.

Receiving a document

Due to the peculiarities of the methodology, the Department of Internal Affairs is filled in federal body authority, but issued by its unit on the spot. The following work is being done:

What are the benefits of veterans


The list of preferences is determined by federal and regional legislation. In addition, the list of benefits depends on the corresponding code stated in the document. So, if the line contains the number "1", then the veteran can apply for the following:

War veterans are entitled to state money. But not to everyone, but only to persons registered before 2005. According to Art. 3 of the Law of 12.01.1995 No. 5-FZ, the following categories of citizens belong to combat veterans:

These persons must take part in hostilities while performing their official duties in the Russian Federation or the USSR.
  2. Servicemen, including those transferred to the reserve or retired, as well as persons who are among the rank and file of the ATS. To be eligible for benefits to veterans of hostilities, these categories of citizens had to take part in government combat missions related to the clearance of the territories of the USSR and other countries in the period from May 10, 1945 to December 31, 1951.   5. Persons who were involved in servicing Soviet or Russian military unitslocated on the territory of foreign states during the conduct of hostilities.   7. Persons performing special tasks in the Syrian Arab Republic, starting from September 30, 2015, provided that they have worked the deadline set during the dispatch or, for good reason, are seconded ahead of schedule.

Sections 1, 2 and 3 of the annex to the law establish a list of territories and the period of time during which hostilities were conducted there.

How veterans' rights are regulated

Persons eligible for benefits for combat veterans may be:

  • citizens of the Russian Federation;
  • foreign citizens permanently residing in the Russian Federation;
  • stateless persons who permanently reside within the Russian Federation.

The above categories of persons are subject to the provisions of the Law of 12.01.1995 No. 5-FZ. The rights of foreigners and stateless persons who temporarily reside or stay in the territory of Russia are regulated by international treaties.

Certificate of a veteran (participant) of hostilities

Participants in hostilities, as well as other persons listed in Law No. 5-FZ, are issued with a certificate of a veteran of hostilities to confirm this status. Citizens claiming the right to receive benefits for war veterans must have such a status.

The form of the veteran's certificate can be found in the decree of the Government of the Russian Federation of December 19, 2003 No. 763. The standard attributes of this certificate are:

Documents for the employees of the Ministry of Internal Affairs who participated in the North Caucasian operations

Filling out the certificate

Registration of the certificate

The finished document is issued to the applicant for signature. Each of the certificates issued to citizens is registered in a special accounting book.

In the accounting book, civil servants registering certificates note the series and number of the document, the full name of the recipient of the certificate, his address, the number of the pension file and the date of issue of the certificate.

Issuance of a duplicate identity card

War Veteran Medal

Such a veteran medal was established on February 19, 2005 in accordance with the regulations adopted by the coordinating council of the committee for internationalist soldiers under the Council of Heads of Government of the CIS member states.

Benefits for War Veterans 2020. What Should Become a War Veteran

  • preference in joining the members of horticultural, vegetable gardening and dacha associations;

Providing land to war veterans. Is there a free allocation

Tax incentives for war veterans

Tax benefits for veterans are provided in the form of:

  • tax relief for the payment of property tax in accordance with Art. 407 of the Tax Code of the Russian Federation;

Who is Eligible for Veteran Welfare Benefits

Monthly cash payment (MCA) is charged to the veterans listed in sub. 1-4 p. Art. 3 FZ of 12.01.1995 № 5-FZ, as well as to family members of the fallen veterans of military operations. The transfer of such payments is carried out regardless of the grounds for their establishment. An exception is made in cases when the payment is transferred in connection with radiation exposure.

Amount of money transfers for war veterans

Monthly cash payment for a person recognized as a veteran, according to sub. 3 p. 4 art. 23.1 ФЗ dated 12.01.1995 No. 5-ФЗ, has a size equal to 1,699 rubles. This amount increases annually after the indexation procedure. Starting from 02/01/2020, it is 3,062 rubles.

How to issue an EDV

The establishment and payment of monthly cash transfers are the responsibility of the regional offices of pension authorities.

Order of the Ministry of Labor of the Russian Federation of October 30, 2012 No. 353n contains the basic rules for the provision of services related to the establishment and transfer of monthly cash payments to veterans. Pension authorities accept applications from eligible veterans and their representatives. Federal law clearly states who has the right to be considered a participant in hostilities. Applicants for the status of participants

There are two statuses for military personnel and civilians who have served in an armed conflict zone: veteran and participant. The confusion stems from the fact that the law is interpreted in different ways. The fact is that the status "participant" is found in many regulations, but nowhere is there a definition for it. Arbitrage practice equates participants with veterans, last changes the legislation confirms this. For this reason, the provisions of the Federal Law No. 5 "On Veterans" also apply to participants.

According to it, the status of a participant or veteran should be assigned to the following groups of citizens:

How to confirm your status

The issuance of a certificate takes place only on the basis of documentary confirmation of the status. Let's figure out what it can be:

  • extract from a personal file;
  • extract from column 17 of the military ID;
  • certificates in the established form from the military registration and enlistment office;
  • certificates of wounds, injuries and contusions received during participation in hostilities;
  • extracts from orders for enrollment in the lists of military units that conducted military operations;
  • travel certificates;
  • extracts from the work book;
  • flight books;
  • premium materials.

In the absence of these documents, certificates are taken from the archives, requests are sent to military units. If the applicant for the rank of a DB participant still serves in one of the units of the armed forces, then the request is sent by the leadership of this formation. Otherwise, you must contact the military commissariat.

In addition to supporting documents, you need to prepare:

  • passport or identity document (make a copy in advance);
  • application, its sample can be taken at the military registration and enlistment office;
  • 2 matte 3 x 4 photos with a free right corner.

Registration is carried out at the place of military registration, in the district commissariat. The commission will spend some time to consider the application and check the documents, after which it will assign the status of a participant or veteran of the database. What is indicated in the certificate

It is important that this document is completed correctly to receive benefits. It looks like a small book. It contains information:

  • document's name;
  • full name of the issuing authority;
  • series and number;
  • photo;
  • complete personal data (full name);
  • signatures of the issuer of the document and its owner;
  • stamp and date of issue.

Who are the participants in the hostilities?

First, let's clarify important pointconcerning terminology. Citizens who have participated in military conflicts are divided into participants and veterans of hostilities (hereinafter UBD and VBD), and these concepts are often confused. The difference is as follows.

  • Only persons who are registered in the ranks of the Armed Forces of the Russian Federation can be granted WBD status. Moreover, their participation in military clashes by virtue of their profession continues for a long time.
  • The UBD status is assigned to non-professional military personnel who are called upon to participate in armed conflicts for a short period. Among them are employees of the Ministry of Internal Affairs, the Federal Penitentiary Service and others public servicesas well as civilians.

From the point of view of a set of social rights and privileges, the statuses of the WBD and UBD are absolutely identical. For this reason, these concepts are not legally differentiated and are regulated by a single law on benefits for veterans ().

  • military personnel (active and retired);
  • citizens called up for military training;
  • employees of the Ministry of Defense (including former employees of the USSR Ministry of Defense);
  • police officers, security agencies, correctional institutions and other government services;
  • representatives of other professions sent to the conflict zone to carry out special tasks.

All of them can count on receiving a WBD certificate in case of participation in armed conflicts both within the country and abroad. At the same time, the list of military conflicts, for participation in which benefits are entitled, is strictly limited by law (annex to the law on veterans).

Currently, events on the territory of the following foreign states are relevant for the assignment of veteran status:

  • military operations in the Syrian Republic (2005);
  • ensuring the security of Russians in South Ossetia and Abkhazia (2008);
  • military operations in Chechnya (1994-1996);
  • anti-terrorist operations in Chechnya and Dagestan (1999);
  • war in Afghanistan (1978-1989).

Citizens who took part in military events recent years in Ukraine, they cannot count on help from the state. The point is that Russia is not an official participant in these military actions.

What does the WBD status give?

Measures of social support for war veterans are enshrined in clause 1 of article 16 of the Federal Law "On Veterans". They include:


  • pension benefits;
  • tax benefits;
  • assistance in solving the housing issue;
  • compensation for utility costs;
  • preferential medicine;
  • monthly payments (EDV);

Let's consider what exactly is included in each of these points.

Veteran's pension

The conditions for WBD's retirement depend on the type of its activity. If this is a serviceman, then he is entitled to an early release at 45, provided that he has served at least 20 years (or if he has 25 years of total work experience). A pension will be assigned to him in the amount of 50% of the monetary allowance received during the service. If the veteran has served more than 20 years, he is also entitled to a 1% bonus for each additional year.

Holders of WBD status, who are not military personnel, retire on general terms - at 55 or 60 years, depending on gender. To receive an insurance pension, they also need to have experience of 9 years and over 13.8 pension points.

Whichever way a participant in hostilities retires, in any case, he can count on a veteran's allowance. Its size is 32% of the fixed insurance rate. In 2020, this figure was 4982.90 rubles. Consequently, the veteran is entitled to 1,594.53 rubles in addition to his pension.

Tax incentives

Veterans are entitled to concessions on a number of taxes - income, land, property, transport.

There is a deduction for WBD income tax, the amount of which depends on the state of health. If, due to participation in military clashes, a veteran was injured, which led to disability, the amount of personal income tax deduction will be 3000 rubles. In other cases - 600 rubles. The application of the deduction allows you to reduce the amount of tax deductions from salaries, thereby increasing the amount that the veteran receives on hand.

When calculating the land tax for the WBD, a reduction in the tax base is also applied. The cost of 600 m 2 of the existing plot is deducted from it. If its size is less than the specified area, there is a 100% tax exemption. The WBD also has the right not to pay tax for one of each type of real estate - house, garage, cottage, etc. ().

Tax incentives for vehicles provided in accordance with the legislation of the regions. In some regions, this is a complete exemption from tax obligations (Stavropol Territory), in others, additional conditions by car power (Moscow, St. Petersburg, Novosibirsk).

Tax benefits are issued by providing a veteran's certificate to the tax office. For deduction of personal income tax, an application is also submitted at the place of employment.

Housing


If the certificate was issued before 2005, housing is provided in accordance with Art. 23 of the Law "On Veterans". In this case, WBD is entitled to a subsidy for the purchase or construction of residential premises. Its size is determined depending on the composition of the veteran's family and market value real estate in the region.

To receive a subsidy, it is not enough just to have WBD status. Help is provided only to those who really need it:

  • living in emergency housing;
  • who do not own a living space;
  • owning tight spaces (less than 18 m 2 for each person).

Upon receipt of WBD status after 2005, housing is provided in accordance with. Apartments for veterans are provided within social agreements... hiring. Owners of emergency housing and persons suffering from severe chronic diseases can get a dwelling without waiting in line.

Compensation of utility costs


The state also provides assistance to veterans in paying utility bills. The amount of compensation is 50%. The benefit applies to housing maintenance services and overhaul, as well as utilities (electricity, water, gas). Half of the paid funds are refunded only if the amount is fully repaid according to the receipt.

Preferential medicine


WBDs are included in the category of recipients of a social set of services, which includes:

  • free distribution of medicines;
  • rest in sanatoriums;
  • payment of travel expenses to the place of treatment (in both directions).

Free rest in the sanatorium is issued through the social services. protection. In addition to the aforementioned certificate from a therapist, you must submit a passport, SNILS and a veteran's certificate there. The issue of issuing a preferential voucher must be resolved within 20 days. Social package services also includes free travel to the health resort and back. If the veteran has a disability and is not able to move independently, a reduced ticket and free travel are also entitled to the accompanying person.

EDV

Monthly payments are assigned by the WBD in accordance with Art. 23.1 of the Law "On Veterans". Their size, according to the results of the last indexation of February 1, 2020, amounted to 1,787.19 rubles. This amount can be increased in case of refusal to set social. services mentioned in the previous paragraph. In monetary terms, it is 1,082.53 rubles, and as a result of its addition, the size of the EDV for the veteran will be 2,869.72 rubles.

How do I get an ID?


The procedure for obtaining WBD status involves the collection required documents and their submission to one of the following authorities:

  • portal "Gosuslugi" (only for registered users).

The basic package of documents required for registration of veteran status includes:

  • passport;
  • case from the military registration and enlistment office;
  • an extract from the order for enrollment in a specific military unit;
  • archival documents proving the fact of being on the territory of a military conflict;
  • photo 3x4 (you can make it for free at the MFC).
