Current situation

The head of the FSSP raised the issue of the possibility of further interaction of systems executive power at different levels in the framework of public-private partnerships. According to Dmitry Aristov, the workload on the department is growing exponentially, and in order to optimize the work of the service, you will need to turn to private organizations for help. Today, there are about 710 companies in the country, one way or another connected with collection activities - 210 head offices and 500 representative offices. And the work of each such institution must be monitored by bailiffs, simultaneously dealing with the problem of "gray" collection.

The question of a possible reform of the sphere has been raised repeatedly. The fact is that the legislative act regulating the work of bailiffs - Federal Law No. 188 of July 21, 1997 - has not undergone changes since its adoption. Over the past 20 years, a lot of socio-economic transformations have taken place in the country, and it is logical to assume that reforms of the FSSP in 2019 and 2020 are likely to occur. If we turn to the latest news, so far the Russian government does not give clear information about the timing of the upcoming adjustments. But you can trace a logical chain of prerequisites that make it possible to judge the possibility of imminent changes:

  • In 2016, employees of the joint venture were assigned to a special category of civil servants, which, according to Federal Law No. 397 of November 22, 2016, is accompanied by the use of special titles, awards and prizes.
  • To serve in this institution, you must have a diploma from a higher education institution. The qualification requirements are established by Art. 12 ФЗ No. 79 dated July 27, 2004 Based on the provisions of this document, only citizens with higher legal or economic education can hold the position of a specialist or leader. Individuals without an appropriate diploma can only apply for the role of a technical specialist. According to experts, today the department employs about ¼ of personnel who do not have specialized education. This means that in the event of reform, about 5.5 thousand employees risk being left without their positions.
  • Work is underway to optimize the service. So, today there are 3 categories of employees: interrogators, bailiffs for OUPDS and bailiffs-executors. All this speaks about the narrowing of powers in order to increase the efficiency of the department's activities. In addition, we are talking about reducing the number of staff of regional branches of the FSSP in order to save budget funds. Thanks to the creation of large territorial departments, the number of personnel can be reduced by more than 2 times, based on 300 employees per 1 region of the Russian Federation.
  • In 2019-2020. we are talking about revising the functionality of employees who will be able to independently dispose of the driver's license of debtors. To suspend the action driving license it will be enough to send a notification about this to the owner of the vehicle. In this case, the amount of debt must be above 10 thousand rubles. In the future, the authority of the department will only expand in this direction: as a result, debtors will not be able to pass exams at the traffic police, register purchased cars and register license plates.
  • To attract specialists to the bailiff service, funds are allocated for the formation of a social package, which includes sanatorium treatment, life and health insurance and other "bonuses".

What to expect in 2019

Good news for FSSP employees is a possible salary increase by 2020. According to preliminary data, the average salary of employees of the department may increase by 1.5-2 times. If today the level of wages is 27-32 thousand rubles. for civil servants of the joint venture, then in 2020 bailiffs will receive about 50 thousand rubles. taking into account ranks, titles and surcharges.

The growth of the payroll is planned to be achieved through the collection of debts and an increase in the percentage of the executive fee, according to the Federation Council. Despite the possible increase in salaries, experts predict an outflow of personnel due to an increase in the burden on civil servants, as well as tightening of qualification requirements for FSSP specialists.

It is planned to continue the introduction of new technologies to automate work enforcement proceedings... Since April 1, 2018, in Moscow with the Moscow City Court, the exchange of documents has been carried out in electronic form, which makes the system more transparent. It remains to solve the issue of automation in the regions, but this is a long and very costly process.

Difficulties of reform

The main problems in 2019 remain:

  • Lack of funding - about 9.5 billion rubles will be allocated for the reform, which indicates the need to attract private investment.
  • Difficulties in conducting personnel certification in accordance with the new requirements.
  • Optimization of the workforce, which can lead to the fact that thousands of people will be left without work.
  • The possibility of abuse of duties by employees of the department due to an incomprehensible situation with the distribution of bonuses, which are planned to be paid to employees by increasing the collection from debtors.

It was known several years ago that the FSSP system should be reformed. Such a need is connected, first of all, with the fact that the work of the Federal Service does not correspond to the current realities. That is why recent years have been a time of change for bailiffs.

The main change, which was mentioned in the Ministry of Justice, concerns the fact that this year all employees of the FSSP must undergo a check in order to confirm their qualifications and high level of training. The main criterion for choosing a candidate is an economic or legal education.

As for the bailiffs who do not pass the check, then they will either be demoted in their posts, or even reduced altogether. The same will apply to those who will not cope well with their duties.

However, these innovations are far from all. Touch on innovation and remuneration. Moreover, it will be possible to clearly see all the changes starting from 2018.

What is the meaning of the planned reform?

The changes planned by the Ministry of Justice will affect all aspects of the work of the FSSP. This can lead to the fact that the position will lose about 5600 people, and, according to preliminary data, this is the number of employees who do not have specialized education.

And all that remains for them is either to get it in a short time, or to say goodbye to their position.

In the management of the service, there are considerable fears that a large amount of work will fall on those who pass the check, and they simply will no longer cope with their duties.

However, the government itself is confident that the reform will bring extremely positive results. FSSP will become more attractive for real specialists.

The main changes that are foreseen in the future will affect primarily:
Employee categories. That is, the categories of employees will be divided into those who have to work in the courts and performers.

Responsibilities will be clearly assigned, it will become easier to do the job. The same can be said about its results. It will become more convenient to check the result.

Salary... This moment for FSSP employees is one of the key ones, and it will also undergo changes. It will be possible to judge how much and how, after the qualification level checks. Upon successful completion, the employee can count on an increase in salary, social guarantees.

Number of employees. As mentioned above, according to preliminary data, several thousand people work in the FSSP without appropriate education. These are likely to be cut. And then, in order to increase the efficiency of work, small branches will be united into interregional ones.

Opportunities. Further plans are to increase the capabilities of the service. Thus, the FSSP can already act as a regulator of the collection market.

According to the reformers, the changes made will contribute to the fact that work in the FSSP will become attractive for young professionals who refuse the opportunity because of low salaries.

As a result of the reform, employee benefits are planned to be raised first to 50% and then to 100%. In addition, rest in sanatoriums will be available for employees, health care and other benefits.

Are there any drawbacks to the reform?

The deficiencies in the reform are still observed, and this despite the optimistic forecasts. First of all, concerns relate to staff reduction. Removing several thousand units is serious.

The second questionable issue concerns the budget. So, in order to organize the activity, more than one and a half billion rubles will be needed, about 150 million will be spent for the arrangement of offices and another 10 million to increase the salaries of employees, and this is monthly.

In addition, the bailiffs themselves do not believe that their salaries can increase by 100%, at best by 5-6%. The requirements for the qualifications of employees are also in doubt. It is assumed that this will increase staff turnover, will not provide guarantees.

At the moment, experts agree that it is worth increasing the prestige of the service, and not starting with redundancies.

Another controversial issue concerns the fact that bonuses for employees will be paid from a fund formed from the collected funds, therefore, this will call for even more harsh actions in their decisions. In some cases, it is even possible with a tangible excess of authority.

Taking into account all these nuances, the reform is viewed with distrust, realizing that if at least some moment is missed, innovations can cause a number of difficulties. However, the government insists that reforms are needed for a long time.

It is still difficult to say how exactly the FSSP will work next year, but the fact that changes are foreseen in the region is for sure.

Bailiffs in our country are government civil servants. By their work activities, they ensure the work of courts and the execution of court orders, including in a compulsory manner. In fact, these are two main areas of their activities. Exists federal Service bailiffs, whose duties, powers and tasks are regulated by the relevant legislation and the Constitution of the Russian Federation.

The executive body, which is this service, performs the simplest, and, at times, dangerous work. This, of course, should be assessed by the state by the appropriate wages. Also, recently there has been an active fight against corruption, and one of the important requirements that ensure its success is the creation of decent working conditions for civil servants. There are not so many people willing to work for a penny on one enthusiasm for the good of the Motherland, which is logical.

Most people first need to provide for themselves, their loved ones, satisfy basic needs, and only then think about high ideals. And it is difficult to reproach citizens doing this kind of work for such a calculation. Therefore, one of the most pressing topics related to civil servants is the discussion of current income, possible reductions, as well. It is these issues, as well as the reasons that led to the current situation, that we will consider in the article.

Reform 2012

Many people know that since 2012 the state system for providing budgetary organizations has been undergoing a number of major changes. Reforms in health care, culture, pension, education are united by the common date of signing the corresponding Decree of the President of the Russian Federation - May 2012, and therefore are often referred to as the "May" reform. In accordance with the regulated sequence of changes, in the period from 2013 to 2018, it was planned to carry out two stages of changes aimed at improving the quality of services provided to the population and improving working conditions. In many cases, this has been and continues to be accompanied by layoffs and the closure of ineffective organizations. The first to suffer from this optimization were institutions in small towns. The second stage involved revising the requirements for employees who provide services, the services themselves and raising the salary of the bailiff and other workers in this area to higher values, also determined by law.

The current situation of the FSSP

In 2014, a decree was signed concerning the issues of the Federal Bailiff Service, regulating, among other things, salaries and staff numbers. Amendments to it are adopted annually taking into account the current temporary changes.



So, according to the 2011 amendments, for 2012 the number of people working in the central office of the FSSP was set at 683 units, and the number of employees territorial bodies - 84 352 units. In the changes in the Decree for this year, the number is determined as follows: 615 employees in the central office and 75,737 employees of territorial bodies. The numbers speak for themselves and do not require comment: in 4.5 years, about 8,600 employees were laid off. Regarding the question of whether there will be a reduction in bailiffs in 2017, there is no definite answer yet.
Previous amendments were made in December, this year they should also be expected at the end. However, a decrease in the number of employees is still very likely, but more on that below.

Payroll to bailiffs

Before discussing the increase in salaries in the judicial system in 2017 in the Russian Federation, it is worth noting that in the current year the salary of FSSP employees, as before, consists of several components: salary, post allowance, monthly incentives, regional coefficient. The salary component is usually indexed and raised, since the rest of the values \u200b\u200bdirectly depend on it.

Without taking into account the increasing coefficients, it is possible to calculate the bailiffs' income this year, based on the data of the official portal of the FSSP:

  • 4541 rubles - salary;
  • 4541 rubles - monthly salary incentive;
  • From 2 724 to 4 086 rubles - a bonus from 60 to 90% of the salary.
That is, the bailiff receives 13,168 rubles, excluding the allowances for the rank. This figure is relevant for new employees working up to six months. Then they are assigned a rank, and the salary is increased by at least 1000 rubles. There are also surcharges for special conditions service for work on Far East, in the north. There are also increasing coefficients in the capital. Supporting specialists or assistants have lower incomes: their salaries range from 2,500 to 3,650 rubles, plus incentives and allowances. The managers have big incomes.

So, as a result of averaging the leading, northern and ordinary salaries, it turns out that the average income of bailiffs is slightly less than 30,000 rubles.

In relation to last year, the size of salaries in the FSSP changed by 5.5%, that is, indexation was carried out, like most citizens.

Changes 2017

Many employees of the FSSP are waiting for the next year - for this period salary increases are expected. But it is not yet clear what the size of the increase will be - either again indexation for inflation, or a more serious increase, in the range of 10-30%. Of course, the indexation of the salaries of bailiffs in 2017, as well as the rest of civil servants, will be carried out. It is already known that these figures are included in the budget plan for next year. But a lot of conflicting information is associated with a large increase. On the one hand, the workload on employees increases due to the ongoing optimization, the requirements are increasing. Therefore, wages should also grow. On the other hand, the lack of budgetary funds does not allow one-time to raise salaries to all by significant numbers. The budget is barely enough for indexing. Therefore, you have to invent other ways in order to appreciate the work of employees at their true worth. Thus, according to information from the media, the Ministry of Justice has prepared a Draft Law with a proposal to increase salaries at the expense of the collected funds. It seems like there will be no expenses from the budget, and employees will be motivated, and salaries will grow. But this is a draft, and it is not yet known whether it will be adopted.

However, some guaranteed innovations are already being announced. So, in 2017, a law comes into force, according to which all accepted and already working employees must have a higher education.... About 5.5 thousand people do not fall under the updated criteria. They will be laid off or offered the position of assistant bailiff with a corresponding salary: assistants can work without higher education or study. There are suggestions that the increase pay federal civil servants in the judicial system in 2017 are expected precisely at the expense of the freed up funds.

What will happen to the salary of bailiffs in Russia is a question that is relevant for many. And the answer is difficult enough, and there are many reasons. The Russian government planned changes 4 years ago in order to finally correct the situation with indecently low incomes of state employees and employees. Unforeseen circumstances of 2014-2015 intervened in the process and postponed them for some time. The stabilization of the economic situation may affect the dates of the revision of wages. Summing up, we can say that an increase in the salary of a bailiff in 2017 in Russia is guaranteed to happen by the amount of projected inflation - 5%, and salaries may increase up to 30%. But only if funds are found for this. So far, there are several possible sources, including the transfer of employees without higher education to the positions of assistants with lower salaries and an increase at the expense of collected funds. In the meantime, it remains to wait for the end of the year and the official, legally confirmed information.

    There are many doubts that wages will be increased, as well as the methods of raising qualifications due to corruption.
